Cornell University does not plan to submit official comments in response to the Department of Education’s new Title IX rule.
On June 23, the Department of Education proposed changes to the rules that implement Title IX. Today, the proposed rule was published in the Federal Register. The Department will accept formal comments from the public through September 12, 2022.
The main purpose of a campus judicial system is to protect the accused student from the hassle and expense of a criminal proceeding and to provide more confidentiality. However, as proposed, the revised Title IX procedures do not offer any benefits.
In sum, the Biden administration’s proposed rule would void any policies or protections that colleges offer students to defend their free expression rights and subject students accused of misconduct to highly unfair procedures. The proposed rule strikes at the heart of the educational process and puts every college student at serious risk of unfair treatment.
